Welcome to Howdies (the “App”), a chatroom-based mobile application available on the Apple App Store and Google Play Store. By downloading, installing, or using the App, you agree to be bound by these Terms and Conditions (“Terms”). Please read these Terms carefully. If you do not agree, discontinue use immediately.

1. Eligibility and User Registration

1.1 Age Requirement: You must be at least 13 years old to use Howdies. If you are under the age of 13, you may not create an account or otherwise access or use the App.

1.2 Registration Process: To access the core chatroom features of Howdies, you must register an account by providing a valid email address. This email address will be used for account verification, password recovery, and important notifications.

1.3 Communication: By registering, you consent to receive communications from us via the email address you have provided. These communications include password resets, policy updates, and other essential notifications related to your account.

2. Optional Information

2.1 Additional Data: You may opt to provide additional personal information, including but not limited to your full name, birthdate, and country of residence. This information is not required for basic functionality but may enhance your experience and enable personalized interactions within the chatroom.

2.2 Voluntary Disclosure: Providing optional information is entirely your choice. If you choose not to share additional details, you will still have access to the core features of the App.

2.3 Profile Customization: By furnishing optional information, you acknowledge that the App may display such details to enhance social interactions, such as suggesting region-specific content or enabling more tailored user connections.

3. Data Storage and Usage

3.1 Secure Storage: Your email address and any optional information are stored securely using industry-standard measures to protect against unauthorized access or disclosure.

3.2 Internal Use: We use your data to provide essential account services and improve the App experience. This includes login authentication, password recovery, update notifications, and personalized features where applicable.

4. Privacy and Security Measures

4.1 Security Practices: We employ encryption protocols and regular security audits to safeguard user data. While we strive to protect your information, no security measures are infallible, and we cannot guarantee absolute security.

4.2 User Responsibility: You are responsible for maintaining the confidentiality of your login credentials. We strongly recommend using a unique, complex password and promptly reporting any suspicious activity related to your account.

5. License and Restrictions

5.1 Limited License: Subject to these Terms, we grant you a non-exclusive, non-transferable license to download, install, and use Howdies for personal, non-commercial purposes.

5.2 Prohibited Actions: You agree not to:

  • Modify, disassemble, decompile, or reverse engineer the App.
  • Rent, lease, loan, resell, or distribute the App or its content.
  • Use the App for any unlawful or prohibited activities.

5.3 Intellectual Property: Howdies, its logo, and all related materials are protected by copyright, trademark, and other intellectual property laws. We retain all rights to the App and its content.

6. Content and Conduct

6.1 User Conduct: You agree to use the chatroom features responsibly and to refrain from posting unlawful, harmful, or offensive content, including but not limited to harassment, hate speech, or explicit materials.

6.2 Content Removal: We reserve the right to remove or disable any content that violates these Terms or is otherwise objectionable, at our sole discretion.

7. Disclaimer of Warranties

7.1 "As Is" Basis: The App is provided on an “as is” and “as available” basis, without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.

8. Limitation of Liability

8.1 No Liability for Damages: In no event shall we be liable for any damages arising out of or in connection with the use or inability to use the App, including direct, indirect, incidental, consequential, or punitive damages.

9. Indemnification

9.1 Your Obligation: You agree to indemnify, defend, and hold us harmless from any claims, liabilities, damages, and expenses (including reasonable attorneys’ fees) arising out of your use of the App or violation of these Terms.

10. Termination

10.1 Termination Rights: We may suspend or terminate your access to Howdies at any time, with or without notice, if you violate these Terms or if we decide to discontinue the App.

10.2 Post-Termination Obligations: Upon termination, you must cease using the App and destroy any copies in your possession.

11. Governing Law

11.1 Legal Jurisdiction: These Terms are governed by and construed in accordance with the laws of the State of New Mexico, without regard to its conflict of law principles.

12. Entire Agreement

12.1 Complete Terms: These Terms constitute the entire agreement between you and us regarding the use of Howdies and supersede all prior or contemporaneous communications, whether oral or written.

13. Updates to These Terms

13.1 Changes to Terms: We may update or modify these Terms from time to time. If significant changes are made, we will notify you via the email associated with your account or through in-App notifications. Your continued use of the App following any modification constitutes acceptance of the updated Terms.
